What is a "functioning judiciary"?
partially functioning?
The sad reality is that many Americans believe the Judiciary is not functioning properly.
In the words of Pope Francis, who am I to judge?
Let’s limit it to criminal law for now.
Does every crime ever committed get prosecuted?
No. That will never be the case.
But some crimes do.
So anyone (other than the President in his official capacity) who breaks any criminal law at any time still might get prosecuted.
And just because someone didn’t get prosecuted last time, that doesn’t mean they won’t get prosecuted next time.
And just because your friend didn’t get prosecuted, that doesn’t mean you won’t get prosecuted.
There’s a bettor’s chance they’ll get you.
Including politicians.
No matter what you’ve heard.
So we do have scandals. We do have outrage. There are times things seem unfair.
But whether you like it or not, we still have a Constitution, and the framework is still in practice, and the government apparatuses exist.
And people talk a lot about what’s coming next.
“Are America’s Institutions at Risk?”
I don’t know.
But the Judiciary remains the best hope we have for justice to predominantly prevail.
